What Is THCA?
A Legal and Scientific Explanation for Law Enforcement and City Officials
THCA (tetrahydrocannabinolic acid) is a naturally occurring, non-psychoactive
cannabinoid found in raw hemp and cannabis plants. It is the precursor to Delta-9 THC,
meaning it only becomes psychoactive after being heated through a process called
decarboxylation.
What Is THCA?
• THCA is produced naturally by hemp and cannabis plants as part of their
cannabinoid profile.
• It does not cause a high unless it is heated (e.g., smoked, vaped, or cooked), at
which point it converts into Delta-9 THC.
• In raw flower and concentrates, THCA is the dominant cannabinoid before any
processing.
Legal Status Under the 2018 Farm Bill
Under the 2018 Federal Farm Bill:
• Hemp is defined as cannabis with less than 0.3% Delta-9 THC by dry weight.
• The law does not regulate THCA directly—only Delta-9 THC.
• Therefore, raw hemp flower containing high levels of THCA is federally legal as
long as its Delta-9 THC level remains below 0.3%.
Note: Even high-THCA hemp that becomes intoxicating only after decarboxylation is legal
if it remains compliant in its raw form.
Natural vs. Synthetic
• THCA is 100% natural—produced by the plant without any chemical conversion or
synthetic manipulation.
• No solvents, catalysts, or lab processing are involved to produce THCA in flower
form.
• It is not a synthetic analog and should not be treated as one.
What Law Enforcement Should Know
• THCA is non-psychoactive and federally legal in hemp flower form under the 2018
Farm Bill.
• Testing should measure Delta-9 THC only, not the potential conversion of THCA.
• COAs (Certificates of Analysis) should be reviewed to confirm legal compliance
(under 0.3% Delta-9 THC).
• Confiscation or prosecution based solely on THCA content may violate federal
protections.

What Is Delta-8 THC?

Delta-8 THC (Delta-8-tetrahydrocannabinol) is a naturally occurring cannabinoid found in
the hemp plant. While present in small amounts in nature, Delta-8 is typically produced
through a process called isomerization using hemp-derived CBD.
What Is Isomerization?
Isomerization is a natural chemical process in which CBD (cannabidiol) is converted into
Delta-8 THC by rearranging its molecular structure. This is done using a solvent (such as
ethanol or heptane) and an acid catalyst (such as citric acid). No synthetic chemicals or
foreign substances are added—this is simply a restructuring of naturally occurring
cannabinoids.
• This process does not create a synthetic compound.
• Delta-8 is biologically and chemically similar to Delta-9 THC, but with milder
psychoactive effects.
Is It Legal?
Under the 2018 Federal Farm Bill (Agricultural Improvement Act):
• Hemp and all its derivatives, including cannabinoids and isomers, are federally
legal if they contain less than 0.3% Delta-9 THC by dry weight.
• Delta-8 derived from hemp-derived CBD falls under this definition and is therefore
federally compliant.
Many independent labs provide Certificates of Analysis (COAs) verifying the THC content
and confirming products meet this legal threshold.
Is It Synthetic?
No. The term "synthetic" refers to compounds manufactured entirely through artificial
means (e.g., K2, Spice). Delta-8, however:
• Occurs naturally in cannabis
• Is created from another natural hemp-derived cannabinoid (CBD)
• Is produced using a safe, transparent, and testable process
What Law Enforcement Should Know
• Delta-8 is not a designer drug or synthetic analog.
• Products made from hemp-derived CBD and tested to be under 0.3% Delta-9 THC
are federally legal.
• All reputable sellers provide lab-tested documentation (COAs) for each product
batch.
• Enforcement actions based on misunderstanding of the law may result in litigation
and public backlash.
If you have questions or require verification, ask for lab reports, batch testing, and
sourcing documentation.
